1. About this agreement
This End User License Agreement (also called the Terms of Use) governs use of Ybarra KPIS at https://ybarrakpis.netlify.app/, operated by Ybarra Hospitality Group ("we," "us," or "our"). The app supports internal restaurant reporting, maintenance, document review, and connected accounting workflows.
Use the app only if you are authorized by us and agree to these terms. If you do not agree, do not use the app and contact your administrator. Reading this public agreement does not create an account or grant access to business records.
2. Your permission to use the app
We grant you a limited, non-exclusive, non-transferable permission to use the app for authorized business duties while your access remains active. This permission is limited to your assigned locations, roles, and features. It does not transfer ownership of the software or let you license, resell, or distribute the app.
The app, its design, and its software remain the property of their respective owners. Business documents and third-party materials remain subject to their existing ownership and permissions.
3. Account responsibilities
- Use your own approved account. Keep sign-in codes and connected-service credentials private, and sign out on shared devices.
- Upload or access information only when you are authorized to do so. Keep submitted information accurate and report mistakes promptly.
- Do not bypass access restrictions, impersonate another user, interfere with the app, introduce malicious files, or access another store's records without permission.
- Report suspected unauthorized access or lost access credentials using the contact below.
4. Documents and decisions
You authorize us and the service providers described in our Privacy Policy to process submitted documents and information as needed to operate the features you use. Do not upload unnecessary personal or confidential information.
AI scanning and automated calculations can produce errors. Review original pages, product descriptions, amounts, dates, allocations, and the destination company before submitting, approving, or exporting a record. The app's reports support business decisions; they do not replace your accountant's, legal adviser's, or other professional's judgment.
Saving a draft is not approval. Creating an unpaid bill in QuickBooks does not pay the supplier. Deleting a draft or message from an ordinary app view does not necessarily erase retained originals, history, or copies already sent to another service.
5. Connected services and messages
Features may use Netlify, Twilio, OpenAI, Dropbox, Intuit QuickBooks, Toast, and other services identified in the Privacy Policy. Only connect accounts you are authorized to manage. Those services have their own terms, privacy practices, availability, and any applicable charges.
For the invoice integration, the authorized owner can open QuickBooks setup, choose a restaurant, and connect, reconnect, or disconnect its company. Disconnecting stops future use of that authorization after the operation completes; it does not delete existing bills or historical records.
Requesting a sign-in code does not enroll you in optional maintenance alerts. Where you receive maintenance texts, message frequency varies with work activity, and your carrier's message and data rates may apply. Reply STOP to stop texts or contact us for assistance.
6. Availability and access
The app is provided as available. We do not promise uninterrupted service, error-free document extraction, or that a connected provider will always be available. Keep the original records required by your business processes and verify important results.
We may update the app or restrict or end access when a role changes, authorization ends, misuse occurs, or security or operational needs require it. Ending access does not by itself delete business records that must be retained.
7. Changes and your rights
We may update these terms as the app changes and will post the updated terms and effective date here. We will provide additional notice when required. Nothing in these terms removes rights or remedies that cannot be excluded under applicable law or changes an employment agreement.
Our Privacy Policy explains how information is handled and how to make a privacy request.
